1. Introduction – Acceptance of Terms
1.1. These Terms of Use ("Terms") govern the access to and use of: (a) the public website of the DVB-T2 Digital Terrestrial Television Service in Cyprus ("Website"); and (b) the Channel Programme Management Portal ("Portal") (together: the "Services").
1.2. By accessing and/or using the Services, you declare that you have read, understood and accepted the Terms. If you do not agree, please do not use the Services.
1.3. The administrator/owner of the Services is Hellas Sat Consortium Ltd ("Company", "we", "us").
2. Description of Services
2.1. The Website provides informational content regarding the DVB-T2 service, frequencies/tuning information, support instructions for end users, as well as methods of communication.
2.2. The Portal is intended for authorised users (e.g. television stations/operators or their representatives) for the uploading of programme files (e.g. weekly schedules), which may be displayed on relevant programme listing pages/functions.
3. Support & Tuning Instructions – Disclaimer of Accuracy
3.1 Support and tuning instructions, including instructions for use with different equipment (e.g. televisions, decoders, antennas), are provided for general information and for user convenience purposes.
3.2. Users' equipment and settings may vary significantly (device model/manufacturer, software version, antenna/amplifier, cabling, local reception conditions, etc.). Therefore, the instructions may not be fully applicable in all cases.
3.3. To the maximum extent permitted by applicable law, the Company does not guarantee that the instructions are always complete, accurate, up to date or suitable for each user's specific circumstances and does not assume any responsibility for any damage, loss, malfunction or service interruption arising from the application or non-application of such instructions, unless otherwise provided by mandatory statutory provisions.
3.4. Users are advised to follow the manufacturer's instructions for their equipment and, where necessary, to seek technical assistance from a qualified technician.
4. Digital Assistant (AI) – Statement of Limitations
4.1. The Website may include and/or provide access to a digital assistant that uses artificial intelligence technologies ("Digital Assistant") to provide instructions and/or responses to users' questions.
4.2. The Digital Assistant provides automated responses, based on available information and precedents. Its responses are intended for general guidance, do not constitute binding legal or technical advice, and may contain errors, omissions or may not reflect the user's specific circumstances.
4.3. To the maximum extent permitted by applicable law, the Company does not guarantee the accuracy, completeness or suitability of the Digital Assistant's responses and is not responsible for actions or decisions taken solely in reliance on them. For important matters, users should seek human support and/or technical verification.
4.4. Users must not input sensitive personal data (e.g. health data) or other personal data (e.g. home address) into the Digital Assistant, where such data is not necessary to resolve the request.
5. Eligibility – Portal Accounts
5.1. Access to the Portal is only permitted to persons who have been provided with an account by the Company and/or have been authorised by a collaborating television operator.
5.2 Portal users must provide true, accurate, current and complete information where requested, and must keep such information up to date.
5.3. Passwords are personal, non-transferable and must not be disclosed. The user is responsible for all actions carried out through their account. In case of suspected breach, the user must immediately notify the Company.
6. User Obligations – Prohibited Uses
6.1. The Services must not be used for any illegal, misleading, offensive or fraudulent purpose or be in violation of the laws of the Republic of Cyprus and European Union law.
6.2. Specifically regarding the Portal, the user declares that the programme files uploaded:
- are accurate and correspond to the actual programme schedule,
- they do not violate third-party rights,
- do not contain malicious software or irrelevant data,
- do not include unnecessary personal data.
6.3. The following are prohibited (indicatively): unauthorised access, interference with operation, scraping, DDoS, reverse engineering, or circumvention of security measures.
7. Intellectual Property
7.1. The content of the Website and the Portal (texts, trademarks, trade names, design, graphics, photographs, code) is protected by intellectual property rights and belongs to the Company or its lawful rights holders.
7.2. Any reproduction, redistribution, copying or other use of all or part of the content is prohibited, unless it is intended for personal/non-commercial use (e.g. printing an excerpt of content for personal use). Any other use (e.g. publication in other media, commercial exploitation, public presentation) requires the Company's prior written consent.
8. Third-Party Content – Channel Programmes
8.1. Channel programme schedules may be derived from files uploaded by authorised third parties. The Company makes reasonable efforts to ensure the technical correctness of the publication/display, but does not guarantee the absolute accuracy or completeness of content provided by third parties and is not responsible for content uploaded by third parties.
8.2. In case of changes or errors, the relevant operator must make corrections without delay.
9. Availability – Maintenance
9.1. The Company may modify, upgrade, suspend or temporarily suspend the operation of the Services for maintenance, security or upgrade reasons.
9.2. The Company may terminate or suspend access to the Portal in the event of a violation of the Terms or a security risk.
10. Disclaimer of Warranties – Limitation of Liability
10.1. The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, the Company makes no express or implied warranties, including but not limited to warranties of merchantability/suitability for a particular purpose/non-infringement.
10.2. To the maximum extent permitted by law, the Company is not liable for indirect, incidental or consequential damages and/or loss of profits, data or reputation, arising from the use or inability to use the Services or from third-party content.
10.3. Nothing in these Terms limits liability that cannot lawfully be excluded (e.g. fraud, gross negligence, personal injury).
11. Data Protection – Reference
The processing of personal data is governed by the Website's Privacy Policy and Cookies Policy.
12. Amendments to Terms
The Company may amend the Terms. Continued use after the publication of amendments constitutes acceptance of such.
13. Governing Law – Jurisdiction
The Terms are governed by the laws of the Republic of Cyprus and, where applicable, European Union law. The Courts of Cyprus shall have jurisdiction, subject to any mandatory provisions.
